FarePilot ("FarePilot", "us", "we", or "our") operates the www.farepilot.com website (the "Website") and the FarePilot mobile application (the "App" and the Website, collectively the "Service"). In this Privacy Policy, we inform you of how we collect, use and disclose the information we collect about you through the Service.

Information We Collect

While using our Service, we may collect certain information from you directly, as well as automatically through your use of the Services.

Registering on our Website. To use the Services, and obtain a link to download the FarePilot App (the “App”) you must first register at www.farepilot.com (the “Website”). (Please note: the App is only available for download and use in certain jurisdictions; it may not be available for download in your jurisdiction.)  If the App is available for use in your jurisdiction, we will send you a link to download it; if the App is not available for use in your jurisdiction, we will send you an email notifying you when it becomes available.  When you register, we collect your name, phone number, email address, and city and state.

Using the App.  To use the app, you must download it and then you must provide your email address, name and phone number.

Save Money. If you decide to use the ‘Save Money’ functionality in the app, we may ask you to provide us with more information regarding your expenses and earnings – information on how you have acquired your car and your average weekly earnings is mandatory in order to use this functionality. We use this information to provide you with personalised and best adjusted offers from a variety of sources, to improve and customize our Service.

Device Information.  The App collects from you and your mobile device certain data:

  • Location Information. We may use and store information about your location depending on the permissions you have set on your device. We use this information to provide features of our Service, to improve and customize our Service. You can enable or disable location services through your mobile device settings; however, the App will not function unless location services are enabled. We continue collecting data in the background even when the app is not running to provide our service.
  • Device Sensors. We also collect other information from your device sensors, such as accelerometer, and gyroscope. We continue collecting data in the background even when the app is not running to provide our services.

We use this information to detect when you start, stop, swerve, change lanes, etc., as well as how fast you are traveling, your route and other trip details. We use this information to provide features of our Service as well as to improve and customize our Service.

Referrals.  We may run a referral program where you can earn rewards for referring other users. We will not collect personal details from you of people you referred. However, we will be able to link your referred friend back to you (via your referral code) if s/he does sign up.

User Content.  If this Service offers any forums for user comments and feedback (or similar), FarePilot may collect the information that you disclose in using such facilities. Please note that FarePilot cannot control other parties' use of the personal data that you make available to any user contact you post through the Services. Please be careful about the personal data you disclose in this way.

Other Information We Collect Automatically.As set forth in more detail in our Cookies Policy, we also may automatically collect the following information about your use of our Services (including our App) through log files, cookies, web beacons, and other technologies: your domain name; your browser type and operating system; page views; links you click; IP address; location information; the length of time you visit our Website and or use our Services; referring URL; access date and time; mobile device ID; location and language information; device name and model; operating system type, name, and version; your activities within the Services; and the length of time that you are logged into our Services. We may combine this information with other information that we have collected about you, including, where applicable, your user name, name, and other personal information Please see the section “Cookies and Other Tracking Mechanisms” below for more information. We also collect other technical data such as your location and recorded journeys and vehicle co-ordinates of your computer, tablet or smartphone, details of the pages you have visited on the Website or App, the web browser you use to surf, previous/subsequent sites that you have visited and the length of your visit/session. How and Why We Process Your Personal Information

We use your information, including your personal information, for the following purposes:

  • Providing Services. To provide our Services to you, including to provide you alerts and information about current passenger demand areas, to log your trip details, and to communicate with you about your use of our Services.
  • Customer Service and Relationship Management. If you contact our Customer Service Centre with a question or a complaint, we may ask you for certain information to identify yourself and to help us respond to your enquiry. We use any personal data supplied to improve our customer support services.
  • Responding to Your Inquiries. To respond appropriately to your questions or complaints, we note details of your question or complaint in our customer database. We may also ask you for contact details in order to keep you informed about your question or complaint.
  • Developing and Improving our Services and other Products and Services. We regularly conduct market research with our customers through surveys, phone calls and other communications, as well as through analysis of the information we collect through the Services. We also use your responses and feedback for quality assessments and to improve your customer experience.  If you choose to participate in providing us feedback, we may process the personal data provided to you (including your name, age, address and email address).
  • Advertising on Third Party Sites. FarePilot uses remarketing services to advertise on third party websites to you after you visited our Website. We, and our third party vendors, use cookies to inform, optimize and serve ads based on your past visits to our Website. Please see our Cookies Policy for more detail.
  • Technical and functional management of the Website and App. When you visit or use the Website or App, we process some technical information about you (such as your IP address, your location as obtained through our App if this is something that you have previously consented to, your recorded journeys on the FarePilot app including your vehicle co-ordinates (if you have consented to collection of your location)) to provide you our Service and to manage them. With this technical information, we are able to manage the Service, for example to resolve technical failures or to improve their reliability.
  • Research and Analysis. FarePilot performs research into market trends through statistical analysis. We use the results of such research to evaluate our current products and services and to adapt our products, and marketing to new developments.

How We Disclose Your Information

We may share your information, including personal information, with your consent, and as follows:

  • Affiliates. We may disclose the information we collect from you to our affiliates or subsidiaries (which may be located outside of the EEA, including in the United States); however, if we do so, their use and disclosure of your personally identifiable information will be subject to this Policy.
  • Service Providers. We may disclose the information we collect from you to third party vendors, service providers, contractors or agents who perform functions on our behalf; these third parties may be located outside of the EEA.
  • Business Transfers. If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected from you to the other company.
  • In Response to Legal Process. We also may disclose the information we collect from you in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena.
  • To Protect Us and Others. We also may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Policy, or as evidence in litigation in which FarePilot is involved.
  • Aggregate and De-Identified Information. We may share and disclose aggregate or de-identified information about users or derived from our users’ use of the Services with third parties for marketing, advertising, research, analytical or similar purposes.

Data Retention

You may cancel your account at anytime.  We may retain a copy of your personal data for a reasonable period of time after that, as part of our business records.  However, personal data from closed or deactivated accounts will be deleted or rendered anonymous within a reasonable time period. Under certain circumstances we will retain personal data from closed or deactivated accounts for longer, such circumstances being the prevention of fraud or to otherwise take actions permitted or required by law.

Do Not Track Disclosure

We do not support Do Not Track ("DNT") signals. Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. However, you can disable certain tracking on our Website by disabling cookies through your browser.  Please note, certain portions of the Website may not work properly if you disable cookies.

Access To My Personal Information

You have the right to request copies of your personal information within our custody and control and details of how we use that information by emailing us at hello@farepilot.com. We may, where permitted under applicable law, charge you a fee for responding to your request for access to the information that we hold about you, or for information about the ways in which we have used your personal information.

 

You may access and modify personal information that you have submitted to us, by emailing us at hello@farepilot.com.  Please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages within the Services for a period of time, and we may maintain copies of such information in our business records.

 

Marketing Purposes

We may send periodic promotional or informational emails to you, about FarePilot and the Service, and, from time-to-time as part of our service.

We may send you 3rd party communications, and/or offers but only if you consented when you signed up. You may opt out of these marketing emails within the app or by emailing us at hello@farepilot.com. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving promotional emails from us, we may still send you e-mails about your account or any Services you have requested or received from us. Also, please note that if you take advantage of a third party offer that FarePilot has sent to you, that third party may collect certain information from you, subject to their own privacy policies.

Security

We have implemented safeguards to protect the information we collect from unauthorized access, use, and disclosure. Please be aware no data security measures can guarantee 100% security.

International Transfer

The information we collect about you may be transferred to, used from and stored in the United States or other jurisdictions where FarePilot, its affiliates or its service providers have operations.  The privacy laws in these jurisdictions may not guarantee the same or an equivalent level of protection of personal information as the jurisdictions in which you reside; in such cases, the purposes and processing associated with any such transfer will comply with all applicable data protection laws, and with our obligation to adequately protect and secure your personal information.  We will ensure that every third party or affiliate to whom we pass your information agrees to treat your information with the same level of protection as required by data protection laws, including those in the UK and EU.

By providing your personal information to us, you consent to the transfer of your information as described above.  

Links To Other Websites

Our Service may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over, and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Third Party Plug Ins

We may include social media features and widgets, such as the Facebook Like button and the "Share this" button, as well as other interactive mini-programs that run on the Services and enable certain features to work (e.g., content sharing and comments). These features may collect your IP address and other usage information. These features are displayed on our Services, but are hosted by third parties, and are subject to their own privacy policies, not this one. If you choose to share our Website, App or content through social media such as LinkedIn, Facebook and/or Twitter, your personal data (such as your name and the fact that you are interested in FarePilot) will also be visible to all the visitors of your personal webpage on LinkedIn, Facebook and/or Twitter. FarePolit is not responsible for the processing of personal data or the privacy policy of such social media websites, and Farepilot's Privacy Policy is therefore not applicable.

Minimum Age

Only persons age 18 or older have permission to access our Service. Our Service does not address anyone under the age of 13 ("Children").  We do not knowingly collect personally identifiable information from children under 13. If we become aware that we have collected Personal Information from a child under age 13 without verification of parental consent, we take steps to remove that information from our servers.

The App is intended for drivers only and should not be used by anyone who is not legally entitled to drive. If you are not legally entitled to drive please do not use the App and / or send us your personal data (for example your name, age, address or email address).

Changes To This Privacy Policy

This Privacy Policy is effective as of April 10, 2017 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.

We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.

If we make any material changes to this Privacy Policy, we will endeavour to notify you either through the email address you have provided us, or by placing a prominent notice on our website.
